1. Introduction
These Terms of Service ("Terms") govern your use of the Voxwise platform ("Service") operated by Fluxwise Ltd, a company registered in England and Wales ("Company", "we", "us", "our").
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Service Description
Voxwise provides AI-powered voice agent software that allows businesses to create, configure, and deploy automated phone agents for handling inbound calls, voicemail, and message capture. The Service includes agent configuration, telephony integration, voice selection, call transcription, and notification delivery.
3. Accounts
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must be at least 18 years old to use the Service. By using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Impersonate any person or entity or misrepresent your affiliation
- Make unsolicited outbound calls (spam, robocalling)
- Transmit harmful, threatening, abusive, or harassing content
- Interfere with or disrupt the Service or its infrastructure
- Attempt to gain unauthorised access to any part of the Service
- Use the Service for any illegal telemarketing or fraudulent purpose
5. Payment and Billing
Certain features of the Service require a paid subscription. Fees are billed in advance on a monthly basis through our payment processor, Stripe. All fees are non-refundable except as required by law.
We reserve the right to change our pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
6. Intellectual Property
The Service, including its design, code, features, and documentation, is owned by Fluxwise Ltd and protected by intellectual property laws. You retain ownership of your content (agent configurations, business data, call recordings) but grant us a licence to process it as necessary to provide the Service.
7. Data and Privacy
Our handling of personal data is governed by our Privacy Policy. By using the Service, you consent to the collection and use of data as described therein.
8. Termination
You may close your account at any time by contacting us. We may suspend or terminate your account if you breach these Terms or for any other reason with reasonable notice, except where immediate termination is necessary to prevent harm.
Upon termination, your right to use the Service ceases immediately. We will delete your data within 30 days of account closure, except where retention is required by law.
9. Limitation of Liability
To the maximum extent permitted by law, the Service is provided "as is" without warranties of any kind. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business opportunities arising from your use of the Service.
Our total liability for any claim arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use after such notification constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
